Il entre en vigueur \u00e0 la date de la signature. Il s\u2019int\u00e8gre dans un texte \u00e0 la port\u00e9e plus large, sign\u00e9 le 13 juillet 2021 au niveau Fonction Publique, et r\u00e9pond \u00e0 une forte demande des agents de mieux concilier activit\u00e9 professionnelle et vie personnelle.<\/em><\/strong><\/p>\n\n\n\n<p>L\u2019accord concerne les personnels affect\u00e9s en administration centrale, dans&nbsp; les rectorats, DSDEN, vice-rectorats, EPLE, CIO\u2026<\/p>\n\n\n\n<p>Ce texte est tr\u00e8s important&nbsp; essentiellement pour les personnels administratifs en EPLE puisque, avec les personnels sociaux et de sant\u00e9, ils pourront d\u00e9sormais acc\u00e9der au t\u00e9l\u00e9travail (article 3 du texte).<\/p>\n\n\n\n<p><strong>Les enseignants (1<sup>er<\/sup> et 2<sup>d<\/sup> degr\u00e9) ainsi que les directeurs d\u2019\u00e9cole ne sont pas concern\u00e9s. <\/strong>En revanche, les personnels de direction des EPLE , les CPE , les personnels de sant\u00e9 peuvent en b\u00e9n\u00e9ficier sous forme de jours flottants uniquement, dans les p\u00e9riodes o\u00f9 les \u00e9l\u00e8ves ne sont pas pr\u00e9sents, ou si la pr\u00e9sence d\u2019un effectif d\u2019adultes est garanti dans l\u2019\u00e9tablissement.<\/p>\n\n\n\n<p>L\u2019exercice du t\u00e9l\u00e9travail est ouvert \u00e0 l\u2019ensemble des personnels fonctionnaires ou contractuels, exer\u00e7ant \u00e0 temps complet ou incomplet, temps plein ou temps partiel, ainsi qu\u2019aux agents en contrat d\u2019alternance et aux stagiaires sous certaines conditions (voir article 5 ).<\/p>\n\n\n\n<p>Il pourra se faire de mani\u00e8re r\u00e9guli\u00e8re ou ponctuelle, \u00e0 jours fixes ou flottants (\u00e0 demander 5 jours \u00e0 l\u2019avance).<\/p>\n\n\n\n<p><strong>Le t\u00e9l\u00e9travail repose sur le principe du volontariat<\/strong>&nbsp; ; il doit faire l\u2019objet d\u2019une demande \u00e9crite de la part de l\u2019agent qui doit recevoir une autorisation \u00e9crite de l\u2019 <em>\u00abautorit\u00e9 administrative comp\u00e9tente\u00bb : <\/em>la personne qui exerce l\u2019autorit\u00e9 sur le personnel dans le service ou l\u2019\u00e9tablissement dans lequel il est en fonction.<\/p>\n\n\n\n<p><strong>Ce n\u2019est pas un droit, ni &nbsp;une &nbsp;obligation<\/strong> (hors circonstances exceptionnelles : pand\u00e9mie, catastrophe naturelle\u2026)<\/p>\n\n\n\n<p>Le t\u00e9l\u00e9travail est r\u00e9versible, \u00e0 l\u2019initiative de l\u2019une ou l\u2019autre des&nbsp; parties, avec un d\u00e9lai de pr\u00e9venance de 2 mois \u00e0 respecter, pouvant se r\u00e9duire ou dispara\u00eetre avec accord des deux parties.<\/p>\n\n\n\n<p>Le recours au t\u00e9l\u00e9travail sous forme de jours flottants est possible au sein de toutes les structures de l\u2019Education nationale mais <strong>2 jours de pr\u00e9sence sur site minimum sont requis<\/strong> quelles que soient les modalit\u00e9s d\u2019organisation (jours fixes ou flottants), sauf d\u00e9rogation pour \u00e9tat de sant\u00e9, grossesse, handicap , situation de proche aidant ( article 17).<\/p>\n\n\n\n<p><strong>Le droit \u00e0 la d\u00e9connexion est acquis<\/strong> \u00e0 tous les agents (en t\u00e9l\u00e9travail ou non) : c\u2019est un droit opposable \u00e0 ne pas subir de sollicitation pendant les heures et p\u00e9riodes non travaill\u00e9es.<\/p>\n\n\n\n<p>Enfin&nbsp; l\u2019exercice en t\u00e9l\u00e9travail ne peut avoir de cons\u00e9quences sur l\u2019attribution d\u2019\u00e9l\u00e9ments variables de la r\u00e9mun\u00e9ration, sur la mobilit\u00e9, l\u2019avancement, la promotion, la formation et \u00e9galement sur l\u2019acc\u00e8s aux emplois de direction et d\u2019encadrement.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><em>Textes de r\u00e9f\u00e9rence :<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000044426132\"><em>article L430-1 du code g\u00e9n\u00e9ral de la Fonction publique<\/em><\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/JORFTEXT000032036983\"><em>d\u00e9cret 2016-151 du 11 f\u00e9vrier 2016<\/em><\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000045464407\"><em>accord Fonction publique du 13 juillet 2021<\/em><\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000043985022\"><em>d\u00e9cret 2021-1123 du 26 ao\u00fbt 2021<\/em><\/a><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Cet accord majoritaire a \u00e9t\u00e9 cosign\u00e9 par 5 organisations syndicales, dont le SNALC, sur les 7 repr\u00e9sentatives au sein du minist\u00e8re de l\u2019Education nationale, le&nbsp; lundi 12 juin 2023.
