C\u2019est d\u00e9sormais de l\u2019histoire ancienne.<\/p>\n\n\n\n<p>En effet, le <a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000050873550\">d\u00e9cret n\u00b0 2024-1263<\/a> relatif aux conditions requises pour l\u2019acc\u00e8s au temps partiel de certains agents de la fonction publique, publi\u00e9 le du 30 d\u00e9cembre 2024, a modifi\u00e9 ces dispositions et ouvert l\u2019acc\u00e8s au temps partiel aux agents contractuels de la fonction publique, quelle que soit leur quotit\u00e9 horaire.<\/p>\n\n\n\n<p>Cette nouvelle disposition concerne en particulier les AESH, puisque 98% d\u2019entre eux se sont vu imposer un temps incomplet par leur employeur (63,2% de quotit\u00e9 en moyenne, d\u2019apr\u00e8s le dernier <a href=\"https:\/\/www.education.gouv.fr\/panorama-statistique-des-personnels-de-l-enseignement-scolaire-2023-2024-416010\">panorama statistique<\/a> du minist\u00e8re).<\/p>\n\n\n\n<p><strong>Le temps partiel&nbsp;: un droit pour tous&nbsp;?<\/strong><\/p>\n\n\n\n<p>Le temps partiel est d\u00e9sormais accord\u00e9 <strong>de droit<\/strong> aux AESH&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00e0 l\u2019occasion de chaque naissance jusqu\u2019au troisi\u00e8me anniversaire de l\u2019enfant ;<\/li>\n\n\n\n<li>\u00e0 l\u2019occasion de chaque adoption jusqu\u2019\u00e0 l\u2019expiration d\u2019un d\u00e9lai de trois ans \u00e0 compter de l\u2019arriv\u00e9e au foyer de l\u2019enfant adopt\u00e9 ;<\/li>\n\n\n\n<li>lorsqu\u2019ils rel\u00e8vent des cat\u00e9gories vis\u00e9es aux 1\u00b0, 2\u00b0, 3\u00b0, 4\u00b0, 9\u00b0, 10 et 11 de l\u2019article <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006072050&amp;idArticle=LEGIARTI000006903694&amp;dateTexte=&amp;categorieLien=cid\">L. 5212-13<\/a> du code du travail, apr\u00e8s avis du m\u00e9decin du travail\u00a0(AESH reconnus handicap\u00e9s, certains AESH en position d\u2019invalidit\u00e9\u2026) ;<\/li>\n\n\n\n<li>pour donner des soins \u00e0 leur conjoint, \u00e0 un enfant \u00e0 charge ou \u00e0 un ascendant atteint d\u2019un handicap n\u00e9cessitant la pr\u00e9sence d\u2019une tierce personne, ou victime d\u2019un accident ou d\u2019une maladie grave.<\/li>\n<\/ul>\n\n\n\n<p><strong>Les autres AESH peuvent demander \u00e0 b\u00e9n\u00e9ficier d\u2019un temps partiel mais il ne leur sera pas forc\u00e9ment accord\u00e9 par l\u2019employeur.<\/strong> En cas de refus, l\u2019AESH devra \u00eatre re\u00e7u lors d\u2019un entretien au cours duquel lui seront expos\u00e9es les motivations du rejet de sa demande.&nbsp;<\/p>\n\n\n\n<p><strong>Quelle quotit\u00e9 horaire&nbsp;?<\/strong><\/p>\n\n\n\n<p>Les quotit\u00e9s de travail \u00e0 temps partiel sont fix\u00e9es \u00e0 50 %, 60 %, 70 %, 80 % ou 90 % d\u2019un temps complet.&nbsp;<\/p>\n\n\n\n<p>Concr\u00e8tement, pour la plupart des AESH, les seules quotit\u00e9s possibles sont 50 et 60%.<\/p>\n\n\n\n<p>\u00c0 noter que le temps partiel peut \u00eatre accompli dans un cadre annuel, sous r\u00e9serve de l\u2019int\u00e9r\u00eat du service.<\/p>\n\n\n\n<p><strong>Quelle dur\u00e9e pour le temps partiel&nbsp;?<\/strong><\/p>\n\n\n\n<p>L\u2019autorisation de temps partiel, si elle est accord\u00e9e, l\u2019est pour une p\u00e9riode comprise entre six mois et un an, renouvelable, pour la m\u00eame dur\u00e9e, par tacite reconduction dans la limite de trois ans. Soulignons cependant que certains employeurs demandent \u00e0 ce que la demande soit d\u00e9pos\u00e9e de nouveau \u00e0 l\u2019issue de chaque p\u00e9riode.<\/p>\n\n\n\n<p>La r\u00e9int\u00e9gration de l\u2019AESH ou la modification des conditions d\u2019exercice du temps partiel peut se faire avant la fin de la p\u00e9riode en cours, \u00e0 la demande de l\u2019AESH, au moins deux mois avant la date souhait\u00e9e. Elle peut aussi se faire sans d\u00e9lai en cas de motif grave, notamment en cas de diminution importante des revenus du m\u00e9nage ou de changement dans la situation familiale (divorce\u2026).<\/p>\n\n\n\n<p>Lorsque l\u2019AESH est en CDD, l\u2019autorisation de travailler \u00e0 temps partiel ne peut \u00eatre accord\u00e9e pour une dur\u00e9e sup\u00e9rieure \u00e0 la dur\u00e9e du contrat restant \u00e0 accomplir.<\/p>\n\n\n\n<p><strong>Et la r\u00e9mun\u00e9ration&nbsp;?<\/strong><\/p>\n\n\n\n<p>L\u2019AESH \u00e0 temps partiel per\u00e7oit son salaire, l\u2019indemnit\u00e9 de fonction, l\u2019indemnit\u00e9 de r\u00e9sidence et le suppl\u00e9ment familial de traitement diminu\u00e9s, proportionnellement \u00e0 la nouvelle quotit\u00e9.<\/p>\n\n\n\n<p>Les AESH qui demandent un temps partiel dans le cadre d\u2019une naissance ou d\u2019une adoption peuvent b\u00e9n\u00e9ficier, sous conditions, de la <a href=\"https:\/\/www.caf.fr\/allocataires\/aides-et-demarches\/droits-et-prestations\/vie-personnelle\/la-prestation-partagee-d-education-de-l-enfant-prepare\">prestation partag\u00e9e de l\u2019\u00e9ducation de l\u2019enfant<\/a>.<\/p>\n\n\n\n<p>Si l\u2019\u00e9largissement du temps partiel \u00e0 tous les personnels contractuels est une avanc\u00e9e, pour le <strong>SNALC<\/strong> ce n\u2019est qu\u2019une goutte d\u2019eau pour les AESH qui sont maltrait\u00e9s par l\u2019institution, que ce soit dans l\u2019exercice de leur m\u00e9tier ou de par leur r\u00e9mun\u00e9ration trop basse, cons\u00e9quence imm\u00e9diate des contrats \u00e0 temps incomplet auxquels ils sont quasi-syst\u00e9matiquement soumis.<\/p>\n\n\n\n<p><a href=\"https:\/\/snalc.fr\/contact\/\"
