S\u00e9nat a adopt\u00e9 \u00e0 l\u2019unanimit\u00e9 la proposition de loi ouvrant la <strong>possibilit\u00e9 d\u2019un CDI \u00e0 l\u2019issue d\u2019un seul CDD de 3 ans pour les AESH<\/strong>, contre deux CDD de 3 ans aujourd\u2019hui.<\/p><p style=\"font-weight: 400;\">Ce texte ayant d\u00e9j\u00e0 \u00e9t\u00e9 adopt\u00e9 par l\u2019Assembl\u00e9e nationale le 20 janvier 2022, suite \u00e0 <a href=\"https:\/\/snalc.fr\/loi-precarite-des-aesh-et-aed-le-cdi-au-bout-de-3-a-6-ans-de-cdd\/\">la proposition de loi de Mich\u00e8le VICT<\/a><a href=\"https:\/\/snalc.fr\/loi-precarite-des-aesh-et-aed-le-cdi-au-bout-de-3-a-6-ans-de-cdd\/\">ORY<\/a>, la loi devient d\u00e9finitive.<\/p><blockquote><p style=\"font-weight: 400;\">Toutefois, &nbsp;le SNALC met en garde sur la formulation de l\u2019article de la loi permettant cette CDIsation au bout de 3 ann\u00e9es de CDD.<\/p><\/blockquote><p style=\"font-weight: 400;\">En effet, l\u2019article 1 de la de loi ainsi formul\u00e9&nbsp; \u00ab&nbsp;<em>Un d\u00e9cret d\u00e9finit les conditions dans lesquelles, lorsque l\u2019\u00c9tat conclut un nouveau contrat avec une personne ayant exerc\u00e9 pendant trois&nbsp;\u00e0 six&nbsp;ans en qualit\u00e9 d\u2019accompagnant des \u00e9l\u00e8ves en situation de handicap en vue de poursuivre ses missions, le contrat peut \u00eatre \u00e0 dur\u00e9e ind\u00e9termin\u00e9e.<\/em>&nbsp;\u00bb dispose que <strong>certains AESH auront acc\u00e8s au CDI au bout de 3 ans de CDD tandis que d\u2019autres n\u2019acc\u00e9deront au CDI qu\u2019apr\u00e8s 6 ans de CDD<\/strong>.<\/p><p style=\"font-weight: 400;\">Lors de son <a href=\"https:\/\/snalc.fr\/proposition-de-loi-du-senat-rien-pour-les-aed-si-peu-pour-les-aesh\/\">audition au S\u00e9nat le 16 novembre dernier<\/a>, le SNALC avait d\u00e9fendu le CDI \u00e0 la fin du premier CDD de 3 ans pour <strong><u>tous<\/u><\/strong> les AESH, et non pour certains seulement.<\/p><p style=\"font-weight: 400;\">Au nom de quoi, certains AESH pourraient-ils \u00eatre CDIs\u00e9s au bout de 3 ans de CDD, et d\u2019autres seulement au bout 6 ans&nbsp;?<\/p><p style=\"font-weight: 400;\">Par cons\u00e9quent, le SNALC sera extr\u00eamement vigilant sur la mise en \u0153uvre de cette CDIsation apr\u00e8s 3 ann\u00e9es de CDD et n\u2019acceptera jamais l\u2019arbitraire ou le favoritisme de quelques sup\u00e9rieurs hi\u00e9rarchiques dans l\u2019acc\u00e8s au CDI des AESH.<\/p><p style=\"font-weight: 400;\">Enfin, le SNALC rejette une hi\u00e9rarchisation et une institutionnalisation de la pr\u00e9carit\u00e9.<\/p><p style=\"font-weight: 400;\">En effet, si le SNALC admet volontiers qu\u2019un CDI est mieux qu\u2019un CDD, qu\u2019un CDI au bout de 3 ans est mieux qu\u2019un CDI au bout de 6 ans, les AESH restent des pr\u00e9caires, aux quotit\u00e9s travaill\u00e9es et salaires incomplets, puisque cette loi ne leur octroie pas un statut, alors que l\u2019objectif final du SNALC pour ces personnels est un statut de fonctionnaire de cat\u00e9gorie B.<\/p><p style=\"font-weight: 400;\">C\u2019est pourquoi le SNALC avait soutenu <a href=\"https:\/\/snalc.fr\/aesh-corps-de-fonctionnaires-cr-20221109\/\">la proposition de loi de Madame Nad\u00e8ge ABOMANGOLI visant \u00e0 cr\u00e9er un corps de fonctionnaires pour les AESH<\/a>.<\/p><p style=\"font-weight: 400;\">Donc NON Monsieur le ministre, cette loi n\u2019est pas une \u00ab&nbsp;<em>avanc\u00e9e significative<\/em>&nbsp;\u00bb, comme vous l\u2019avez post\u00e9 sur Twitter, elle est tout au plus pour le SNALC, un moindre mal sur l\u2019\u00e9chelle de la pr\u00e9carit\u00e9&nbsp;!<\/p><p style=\"font-weight: 400;\">&nbsp;<\/p><p
